Send When Terms of Use

1. Who we are

Send When is made by Jack Palmer ("we", "us"). Our address is 19 Riverside Rise, Allington, Salisbury, SP4 0AF, United Kingdom. Contact us at support@sendwhen.net or through www.sendwhen.net/support. For privacy, write to privacy@sendwhen.net.

These terms cover the Send When iPhone app and the website at sendwhen.net. By creating an account or using the app, you agree to them. If you do not agree, please do not use Send When.

2. What Send When does

You write a note, in text, voice, photos or files. You choose when it should come back, and whether by push notification, email or both. At that time we send it. You can also add other email addresses and send notes to them (see section 8).

Send When is not for emergencies or critical reminders. Do not rely on it for medicines, medical care, safety, deadlines with legal effect, travel or anything where a missed or late message could cause harm or serious loss. Use a tool built for that, and keep a second reminder.

3. No guarantee of delivery or exact timing

We work hard to deliver every note on time. But we cannot promise it, because delivery depends on things we do not control: your phone's settings (Focus modes, Low Power Mode, notification permissions), Apple's and Google's push services, your email provider's filters, your network and your device.

So we do not guarantee that a note will arrive, arrive at the exact minute, or arrive only once. We are not liable for a note that is late, missing or delivered twice, except as set out in section 13. You should check that your notification settings are on, and that an address is correct, before you rely on a note.

4. Your account

  • You must be at least 13 to use Send When. If you are under 18, you need a parent or guardian's permission.
  • You sign in with Apple or with a code sent to your email address. Keep your device and email account secure. You are responsible for what happens under your account.
  • Give us true information, and keep your email address current.
  • One person, one account. Do not share your account.

5. Subscriptions and payment

Plans. Send When needs a subscription or a one-off purchase to create and schedule notes. There is no free plan. The plans are monthly (£2.99), yearly (£14.99) and "Pay once" (£39.99). Prices are shown in the app before you buy and may change; we will not change the price of a plan you have already bought during its current period.

Apple handles billing. You buy through the App Store. Apple charges you, renews the subscription, takes cancellations and decides refunds. We do not see your card details. To cancel, go to Settings > [your name] > Subscriptions on your iPhone, at least 24 hours before the period ends. To ask for a refund, use reportaproblem.apple.com. Deleting the app or your Send When account does not cancel a subscription. You must cancel it with Apple.

Free trial. The yearly and monthly plans start with a 7-day free trial. The trial is limited to 100 scheduled notes. Drafts do not count. Apple allows one trial for each subscription group per Apple ID. If you do not cancel before the trial ends, Apple starts charging you.

Pay once. This is a single payment, not a subscription. It gives you access to the paid features for as long as we run Send When. It does not cancel, replace or refund any subscription you already have; cancel that with Apple. If we ever close Send When, we will give you at least 90 days' notice in the app and by email, so you have time to export your notes. We do not refund Pay once when Send When closes.

When your plan ends. When a trial ends or a subscription lapses, your account becomes read-only. You can still open and read your notes. You cannot create or schedule new ones. Notes that were waiting to send, including repeating notes, stop and move to Drafts, and nothing more is sent. If you resubscribe, you can schedule them again from Drafts. A subscription lapses when the paid period ends, not when you tap Cancel.

Your cancellation rights. If you are a consumer, you have rights under UK law, including a right to cancel in some cases. For digital content, that right can end once you start using it, if you agreed to that at purchase. These terms do not take away any statutory right. Apple's own refund process also applies.

6. Acceptable use

Do not use Send When to:

  • break the law, or write or send content that is unlawful, threatening, abusive, harassing, hateful or sexually explicit involving anyone under 18;
  • send spam, bulk or unwanted messages, or messages that pretend to be from someone else;
  • send anything to a person who has not agreed to receive it (see section 8);
  • store or send malware, or try to break, overload or get around our systems or limits;
  • store or send other people's private data you have no right to hold; or
  • resell the service or use it to build a competing one.

Please do not use notes to store passwords, card numbers or similar secrets. Delivery emails are not end-to-end encrypted, and a push notification can show on your lock screen.

If you break these rules, we may remove content, stop deliveries, suspend or close your account. Where we can, we will tell you first and say why. We may act without notice if there is a risk to others or to the service. Closing an account for a breach does not entitle you to a refund from us; Apple's process still applies.

7. Your content

Your notes, voice notes, photos and files stay yours. We do not claim ownership of them.

You give us a limited licence to store, process, copy and send your content, for the one purpose of running Send When for you: saving it, scheduling it and delivering it to the addresses and devices you choose. We do not use it for advertising, and we do not sell it. The licence ends when your content is deleted, apart from short-lived copies in backups.

You promise that you have the right to use what you add, and that it does not break the law or anyone's rights.

8. Sending notes to other people

You can add verified email addresses and send notes to them. Only add people who have agreed to receive notes from you. We send each address a short code first and nothing else is sent until the code is entered, but entering it only proves the address is reachable. It is your job to make sure the person wants your notes.

You are responsible for the notes you send to others. Do not use this feature for marketing, mass mailing, harassment or anything in section 6.

Anyone who receives notes can ask us to stop. Every delivery and verification email we send to another person has a one-tap "Stop all emails from Send When users" link. Using it stops all emails to that address from every Send When user, and removes the address from their accounts. You can also write to privacy@sendwhen.net from that address, and we will stop sending to it and remove it. We may also remove an address on a complaint.

9. Deleting your data

You can delete any note, or your whole account, in the app (Profile). When you delete your account we remove your notes, drafts, tags, templates, delivery addresses, device tokens and sign-in account straight away, and anything scheduled is cancelled. Emails already delivered stay in the recipient's inbox. Apple and our subscription provider keep their own purchase records. Copies in backups expire on a schedule, as set out in the privacy policy.

To keep the service tidy, a delivered note, with its voice note and attachments, is deleted automatically 365 days after it was delivered. Drafts and notes still waiting to be delivered stay until you delete them. Our privacy policy has the full detail.

10. Our service and these terms may change

We may change or improve the app, and we may stop offering a feature. If a change makes the service materially worse for people who have paid, we will give notice in the app or by email and, where fair, an option to leave.

We may update these terms, for example for a change in the law or in how Send When works. For a material change we will give at least 30 days' notice in the app or by email. If you keep using Send When after the change takes effect, you accept it. If you do not agree, stop using the service and delete your account.

If we need to close Send When, we will give you notice as set out in section 5 and will not charge you again.

11. Our content and the app

The Send When name, logo, design and software belong to us or our licensors. Apple gives you a personal, non-transferable licence to use the app on Apple devices you own or control, under the Apple EULA (section 15), including Family Sharing. Do not copy, resell, reverse-engineer or try to extract the source code, except as the law allows.

12. Other companies' services

Send When relies on other companies, including Apple (payments, push delivery, Sign in with Apple), Supabase (storage), Resend (email), Google (push) and RevenueCat (subscriptions). Their own terms apply to their part. They are described in our privacy policy. We are not responsible for outages or failures that are theirs, though we do take care in choosing them.

13. Our responsibility to you

We will provide Send When with reasonable care and skill, and as described in the app. Nothing in these terms limits any right you have as a consumer under the Consumer Rights Act 2015, including that digital content must be of satisfactory quality, fit for its purpose and as described, and that services must be performed with reasonable care and skill. If something is faulty, you may be entitled to a repair, a replacement, a price reduction or a refund.

We do not exclude or limit our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • anything else the law does not allow us to exclude or limit.

Subject to that, and to the extent the law allows:

  • we are not liable for losses that were not a foreseeable result of our breach, or for loss of profit, business, data or opportunity (we are a consumer service and not designed for business use); and
  • our total liability to you for all claims in any 12-month period is limited to the amount you paid us through the App Store in the previous 12 months, or £50, if that is higher.

We are not liable for a failure caused by something outside our reasonable control, such as an outage at Apple, Google, an email provider or your network.

If you use Send When for business, we are not liable for lost profit or business loss at all.

14. Ending your use

You can stop using Send When at any time by deleting your account (see section 9). Remember to cancel any subscription with Apple.

We may suspend or end your account if you break these terms, if we must by law, or if we stop running Send When. We will give notice where we can. If we end your account without a breach by you, we will tell you what happens to anything you have paid for.

15. Apple

Your licence to use the app comes from Apple's standard Licensed Application End User License Agreement (the "Apple EULA"), which you accept when you get Send When from the App Store. These terms sit alongside the Apple EULA and cover the service, your account and your content. If the two disagree about your licence to use the app, the Apple EULA applies.

These terms are between you and us only, not Apple. We, not Apple, are responsible for Send When, its content, and its maintenance and support.

16. General

  • Law and courts. These terms are governed by the law of England and Wales. If you live in England and Wales, the courts of England and Wales can hear any dispute. If you live in Scotland or Northern Ireland, you may bring a claim in your local courts too. Nothing here removes any protection you have under the law of the part of the UK where you live.
  • Whole agreement. These terms, the Apple EULA (section 15) and our privacy policy are the whole agreement between you and us about Send When.
  • If part is unenforceable, the rest still applies.
  • Our delay is not a waiver. If we do not enforce a right straight away, we can still enforce it later.
  • Third parties. No one other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
  • Disputes. If you are unhappy, please write to us first, and we will try to put it right. We do not use an alternative dispute resolution (ADR) provider.
